Mass HIway Regulations and Policies & Procedures

The state regulations, 101 CMR 20.00:  Health Information Exchange, also known as the "Mass HIway Regulations" took effect February 10, 2017. The final regulations are available here.

To assist stakeholders in reviewing these final regulations, the Mass HIway has released the following documents:

  • Mass HIway Regulations Summary The current version of this document is an update of the November 2016 version that accompanied the draft regulations circulated for public comment.  The document provides a two-page summary of key components of the final regulations. The summary can also be found on the Mass HIway website here.
  • Mass HIway Regulations FAQs: This document provides answers to questions that EOHHS has received from stakeholders about the regulations, and offers more information about how the regulations apply to stakeholders. Mass HIway Regulations FAQs can also be found on the Mass HIway website here. 

The Mass HIway Policies & Procedures (Version 3), which now include the new Mass HIway Participation Agreement and Business Associate Agreement, took effect on February 10, 2017.

As per the notification released on November 18, 2016, the Mass HIway Policies & Procedures has undergone a significant update in order to align with the final Mass HIway Regulations, to streamline documentation and contracts, and to update procedures and practices to reflect changes in the healthcare information technology environment.

Current Mass HIway Participants:

Note that current Mass HIway Participants do not need to execute a new Mass HIway Participation Agreement. The Participation Agreement and attached Business Associate Agreement have been amended pursuant to the terms of the executed agreement. Please review to the full Notice of Amendment released on January 20, 2017 for the full description of changes to the Mass HIway Policies & Procedures.

Current Mass HIway Participants must comply with the updated Mass HIway Policies & Procedures (Version 3), which include the new Participation Agreement and Business Associate Agreement in order to access and use the Mass HIway.

Participants joining after February 10, 2017:

Participants joining the Mass HIway after February 10, 2017 will execute the new Participation Agreement in order to access and use the Mass HIway. View the full Steps to Enroll here.
